ALERT: UNPAID REUSE
September 28, 1999
Photographers and stock agencies should check their records to determine if
they had a usage in Glencoe/McGraw-Hill's 1995 edition of Biology: The Dynamics of Life. .
This was published by the Westerville, Ohio division and Mark Steinmetz was the
original editor.
Photographers have discovered that most of the images were re-used in a 1998 revision
and none of the contributors were paid for this second usage. Glencoe's has argued
that only 7.5% of the book was changed and thus it does not qualify as a
revision. PACA has argued that anything over 5% change should be considered a
revision and an additional 75% of the first use fee should be paid for revisions.
While Glencoe is not admitting that they did anything wrong, some contributors who have
complained have received payment recently. It is believed Glencoe is preparing to
issue checks to all contributors.
Glencoe also produced a CD with the original edition and it is not clear if that was
revised for the 1998 edition.
Depending on the rights you licensed with the first edition, it may be appropriate to
check with your editor to determine if there were other uses of your images and how
Glencoe plans to compensate you for those uses.
